Scarborough 31.10.2020 – Following a join submission by Ontario Centre for Policy Research (OCPR), Canada and London Initiative, UK, sources available to Sri Lankan Canadian Action Coalition (SLCAC) have reported with a high probability that there may not be a relief granted to de-proscribe the LTTE Tamil Terrorist group in UK.
The report also highlighted the Proscribed Organizations Appeal Commission decision is flawed, and it may pave the way to appeal. However, POAC has not issued any relief against LTTE Tamil terrorist Group. There will be another hearing to obtain relief as sought by the appellants TGTE members, Arumugam and others. Since OCPR is not a party to the matter cannot intervene directly.
The House of Commons retains its present supremacy in relation to financial and general legislation, but the Second Chamber has equal powers concerning amendments to the Constitution and to constitutional legislation, that is, statutes which give effect to or have a direct bearing on provisions of the Constitution. Therefore, the House of Commons and the House of Lords has the legal authority to overturn the decision by POAC.
A written Constitution gives a much greater role to the Judiciary and therefore given particular attention to the reorganization of the administration of justice and the independence of the Judiciary. There is to be a Supreme Court for the United Kingdom, appointed on the recommendation of the United Kingdom Judicial Appointments Commission, with original and exclusive jurisdiction in any proceeding concerning the validity of Parliamentary or Assembly legislation brought by the Government of the United Kingdom or an Assembly Executive; and appellate jurisdiction in other constitutional matters.Therefore, this matter can be argued up to the Supreme Court, United Kingdom.
Further, the OCPR report highlights the consequences of the LTTE Tamil terrorist group’s de-proscription to British society as a whole.
